When tips fall short

If a worker's cash wage plus reported tips do not average to the Hawaii minimum of $14.00 per hour over a workweek, the employer must pay the shortfall. Under the 2021 DOL final rule, time spent on non-tip-producing work above 20 percent of the shift (or 30 continuous minutes) must be paid at the full minimum, not the tip-credited rate. [DOL FS-15]

Background

Act 114 (2022) phases the rate to $16.00 on 2026-01-01, then $18.00 on 2028-01-01. Tip credit capped at $1.25 per hour, expanding to $1.50 in 2028, only when combined wage exceeds the state minimum by at least $7.00.
